Refund Policy and Cancellations

This agreement (“Agreement”) is a binding agreement between you (“you”) and Elvis Advice (“Elvis Advice” "Website" “Company,” “we” or “us”). By using the site at www.elvisadvice.com (the ‘Site’) or any information, materials, images, graphics, data, text, files, links, software, messages, communications, content, organization, design, compilation, magnetic translation, digital conversion, HTML, XML, Java code and other content related to the Site (collectively ‘Content’) or services provided in connection with the Site (the ‘Service’), you agree to abide by these Terms of Use, as the Company may amend them from time to time in its sole discretion. YOU AGREE THAT BY USING THE SERVICE YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THIS AGREEMENT.

1. Refund Policy Overview

We stand behind the quality of our digital programs and want you to be fully satisfied. That’s why we offer a 30-day money-back guarantee on eligible digital products.

  • Refunds must be requested within 30 calendar days of the original purchase date.

  • Refunds apply to qualifying digital programs only.

  • Subscriptions, event tickets, and promotional or discounted offers clearly marked as “non-refundable” are not eligible.

  • Refunds will be issued minus payment processing fees.

  • Upon refund, access to all related materials will be revoked.

  • While the refund process is straightforward, all refund requests are subject to review to prevent abuse.

1.1 Geographic Scope and Jurisdiction

This refund policy is governed by the laws of Ontario, Canada, without regard to its conflict of law provisions. If you are accessing our products from outside Canada, please note that your local consumer protection laws may provide additional or different rights. Nothing in this policy is intended to limit any non-waivable consumer rights that may apply in your jurisdiction.

By purchasing our products and agreeing to these terms, you consent to receive electronic communications from us regarding your purchase, including order confirmations, refund notifications, and other transaction-related information. These electronic communications satisfy any legal requirement that such communications be in writing.

2. Refund Eligibility Requirements

2.1 Qualification Criteria

To qualify for a refund, ALL of the following must be met:

Timing: Request submitted within 30 calendar days of the purchase date

Method: Request submitted through your account's billing settings OR email to support@elvisadvice.com with "Refund" or "Refund Request" in the subject line

Feedback: Brief explanation of why the product or service didn't meet your needs

Product/Service Type: Must be an eligible product or service (see details below)

2.2 What's Eligible for Refunds

2.2.1 Digital Products

  • Digital courses and training programs

  • Downloadable materials and resources

  • One-time digital purchases

  • Bundle purchases (refunded as a complete bundle only)

2.2.2 Services

  • Consulting services (if cancelled within the eligibility period)

  • Coaching programs (subject to specific terms)

  • Done-for-you services (if not yet started or delivered)

  • Other professional services as specified in service agreements

2.2.3 Bundle Purchases

If you purchased a bundle (such as the Internet Traffic Academy Bundle):

  • Refunds apply to the entire bundle purchase, not individual components

  • The refund amount will be for the discounted bundle price you paid, not the combined value of individual products

  • All access to all products in the bundle will be revoked upon refund

2.3 What's NOT Eligible for Refunds

2.3.1 Specific Products and Services

We may offer special offers for specific products and services that may not follow our general 30-day refund policy. These products are either not eligible for refunds or may have their own terms and conditions.

Below is a list of products for reference:

  • Mission 1000

  • Digital Business Hub

  • Digital Business Academy

2.3.2 Time-Based Exclusions

  • Any product or service purchased more than 30 days ago

  • Subscription services (after first 24 hours)

2.3.3 Usage-Based Exclusions

  • Partially used or consumed services

  • Completed service deliverables

  • Services where work has already been performed

2.3.4 Special Categories

  • Event tickets and live training sessions

  • Products or services clearly marked as "non-refundable"

  • Promotional or heavily discounted offers marked "non-refundable"

  • Gift purchases (must be requested by original purchaser)

2.3.5 Automatic Refunds (No Request Needed)

  • Duplicate charges

  • Services cancelled by us

  • Overcharges or billing errors

3. Digital Products Refund Policy

3.1 Products Covered

This section applies to all digital products sold by Elvis Advice, including but not limited to Internet Traffic Mastery (ITM), Internet Traffic Academy (ITA), and any related digital courses, trainings, or downloadable materials.

3.2 Digital Content Nature Disclosure 

Unlike physical products, digital content cannot be "returned" in the traditional sense. When we process a refund for digital products, we revoke access to the content and require you to delete any downloaded materials. By purchasing digital products, you acknowledge and agree to these terms.

3.3 30-Day Money-Back Guarantee

We stand behind our digital products with our 30-day "Sleep-on-it" Guarantee:

  • You have 30 calendar days from your purchase date to request a refund

  • The 30-day period begins on the day of purchase, not when you first access the materials

3.4 How to Request a Refund for Digital Products

To request a refund, please email support@elvisadvice.com with either “Refund” or "Refund Request" in the subject line.

3.5 Specific Refund Requirements

To qualify for a refund on digital products:

  • 1. You must submit your request within the 30-day refund period

  • 2. You may need to provide your receipt for order verification.

  • 3. You must provide brief feedback on why the product didn't meet your needs

3.6 Digital Product Bundle Purchase Refunds

If you purchased a bundle (such as the Internet Traffic Academy Bundle):

  • Refunds apply to the entire bundle purchase, not individual components

  • The refund amount will be for the discounted bundle price you paid, not the combined value of individual products

  • All access to all products in the bundle will be revoked upon refund

3.7 Price Match and Discount Policy 

If you purchased a product using a discount code or during a promotion, your refund will be for the actual amount paid, not the original list price. If you purchased a product that is later discounted, we do not offer partial refunds to match the new price.

We do not price match with other providers or platforms selling similar content.

3.8 Non-Refundable Digital Products

The following are not eligible for refunds:

  • Any subscription-based digital products after the first 24 hours

  • Promotional or heavily discounted offers clearly marked as "non-refundable"

  • Digital products purchased more than 30 days ago

We process all eligible refunds within 14 business days to the original payment method used for purchase.

5.1 Processing Fee Deductions

When issuing refunds for digital products:

  • Full refunds will be issued minus the payment processing fees charged by our payment processors (typically 2.9% + $0.30 per transaction for credit card payments through Stripe or PayPal)

  • These processing fees are charged by the payment processor and are non-refundable to us

  • 1st example, on a $100 purchase, the processing fee would be approximately $3.20, resulting in a refund amount of $96.80

  • 2nd Example: If you purchased our Traffic Academy Bundle for $1997, your refund would be $1997 minus approximately $58.21 in processing fees, for a net refund of approximately $1938.70.

  • For subscriptions, only the most recent payment processing fee will be deducted from the refund

By purchasing our products, you acknowledge and agree to these refund terms, including the deduction of payment processing fees from any refund amount.

5.2 Tax Refund Policy

When a refund is issued:

  • Sales tax or VAT collected on your original purchase will be refunded along with the purchase price

  • In jurisdictions where digital products are tax-exempt, no tax refunds will apply

  • For international customers in countries with VAT, we will refund the VAT amount collected at the time of purchase

  • Tax refunds are subject to applicable tax laws and may vary by jurisdiction

  • Tax documentation for refunds will be provided upon request to support@elvisadvice.com

5.3 International Customer Considerations

For customers outside of Canada:

5.3.1 Currency and Exchange Rates

  • Refunds will be issued in the same currency as the original transaction

  • Currency conversion rates are determined by your payment provider or credit card company, not by Elvis Advice

  • Any currency conversion fees, international transaction fees, or exchange rate fluctuations that occurred during the original purchase or refund are not refundable

5.3.2 International Processing Times

  • Processing times for international refunds may be longer (up to 21 business days), depending on your financial institution and country

5.3.3 Wire Transfer Fees

  • International wire transfer fees, if applicable, will be deducted from the refund amount

6. How to Request Refunds

6.1 Cancellation Instructions

6.2 Required Information

To qualify for a refund:

  • 1. You must submit your request within the 30-day refund period

  • 2. You may need to provide your receipt for order verification.

  • 3. You must provide brief feedback on why the product didn't meet your needs

6.2 Required Information

We process all eligible refunds within 14 business days to the original payment method used for purchase. It may take up to 30 days for your bank to reflect the refund. Please contact our support if it has been over 30 days and no refund is reflecting in your bank account.

7. Subscription and Recurring Payments

7.1 Continuous Service Agreement

By purchasing subscription-based products, you acknowledge that you are authorizing recurring payments until you cancel. Each payment period constitutes a new agreement to purchase access for that period. You expressly acknowledge that:

  • 1. Your subscription will automatically renew every 30 days

  • 2. Cancellation affects only future charges to your account

  • 3. Cancellation does not entitle you to a refund of payments already made

  • 4. Subscription fees are non-refundable and will not be prorated as the service is deemed used when accessed

7.2 Payment Authorization

If you purchase our products or services that are subscription-based:

  • You agree to pay the subscription fee with your credit card or other payment methods

  • You authorize automatic recurring billing until you cancel

  • Your account will be charged every 30 days for monthly subscriptions

  • You authorize the Company to initiate debit entries from the account provided for the subscription fee

  • You authorize the Company to charge your payment method for any other purchases made on the Site

7.3 Cancellation Instructions 

To cancel your purchase or subscription: 

  • 1. Log in to your account at elvisadvice.com

  • 2. Navigate to "Billing Settings" 

  • 3. Select the product you wish to cancel 

  • 4. Click "Cancel Purchase" or "Request Refund" 

  • 5. Complete the short feedback form 

  • 6. Submit your request 

Alternatively, you may email support@elvisadvice.com with "Cancellation Request" in the subject line. You may cancel at any time by using these methods, but please note that cancellations take effect at the end of your current billing period.

7.4 Failed Payment Handling for Subscriptions

If your payment method fails for subscription renewals:

  • We will attempt to process your payment up to 3 times over a 7-day period

  • You will receive email notifications after each failed payment attempt

  • If all retry attempts fail, your subscription will be paused and access to subscription benefits will be temporarily suspended

  • You may reactivate your subscription by updating your payment information in your account settings

  • After 30 days of non-payment, your subscription will be permanently canceled

  • No refunds will be issued for service periods where access was suspended due to payment failure

8. Special Purchase Types

8.1 Gift Purchase Refunds

For gifts purchased for others:

  • Refund requests for gifts must come from the original purchaser, not the recipient

  • Refunds will be issued to the original payment method used by the purchaser

  • Gift recipients wishing to return a gift should contact the purchaser to initiate the refund process

  • Gift receipts provided to recipients can be used to verify purchase information, but do not entitle recipients to direct refunds

8.2 Promotional Credit and Gift Card Policy

For purchases made using promotional credits or gift cards:

  • Purchases made entirely with promotional credits or gift cards will be refunded as store credit only

  • For purchases made partially with promotional credits and partially with standard payment methods, the standard payment portion will be refunded to the original payment method, while the promotional portion will be refunded as store credit

  • Promotional credits issued as part of a special offer or compensation are typically non-refundable unless otherwise specified

  • Expired promotional credits cannot be reinstated as part of a refund

9. Post-Refund Processing

Upon receiving a refund:

  • Your access to the digital product(s) will be removed within 3 business days

  • You agree to delete any downloaded materials and stop using the content

  • You will receive confirmation of your refund via email once processed

9.1 Access Revocation Timing

Upon refund approval:

  • Access to digital content will be revoked within 24 hours of refund approval

  • Downloaded materials should be deleted immediately after receiving the refund confirmation

  • For courses with community components, access to community forums or groups will be removed within 48 hours

  • Any certificates or credentials earned through the program will be invalidated upon refund

  • We recommend downloading any personal notes or progress tracking before requesting a refund, as this information cannot be recovered after access is revoked

9.2 Content Deletion and Copyright Compliance

By requesting a refund, you acknowledge that continuing to use, share, or distribute the digital content after the refund constitutes copyright infringement. We reserve the right to pursue legal action against individuals who continue to use or distribute our intellectual property after receiving a refund.

10. Class Action Waiver and Dispute Resolution

10.1 Chargeback Policy

Credit card chargebacks represent a significant cost to small businesses and should only be used as a last resort.

10.1.1 Pre-Chargeback Requirements

Before initiating a chargeback, please contact support@elvisadvice.com to attempt to resolve any issues

10.1.2 Consequences of Improper Chargebacks

If you file a chargeback without first attempting our standard refund process, your account may be suspended, and you may lose access to all purchased products.

If you file a chargeback after receiving a refund, you may be responsible for any fees incurred by Elvis Advice.

Fraudulent chargebacks will be contested and may result in permanent account termination.

10.1.3 Account Termination Policy

We reserve the right to ban future purchases from customers who abuse the chargeback process.

10.2 Class Action Waiver and Arbitration

Any dispute arising from purchases, refunds, or this policy will be resolved through individual arbitration rather than class action. You agree to waive any right to participate in class actions or representative proceedings regarding any issues related to purchases from Elvis Advice. All claims must first be submitted to support@elvisadvice.com for resolution before pursuing other remedies. Both parties agree to attempt a good-faith resolution for at least 30 days before initiating arbitration or legal proceedings. If arbitration becomes necessary, it shall be conducted in Ontario, Canada, by a mutually agreed-upon neutral arbitrator in accordance with the rules of the ADR Institute of Canada.

11. Administrative Polices

11.1 Record-Keeping Practices

We maintain records of all refund requests and resolutions for a period of 7 years in accordance with standard business practices. You may request information about your refund history by contacting support@elvisadvice.com. We will make reasonable efforts to provide this information within 10 business days of receiving a verified request.

11.2 Force Majeure Clause

Our ability to process refunds may be affected by events beyond our control, including but not limited to natural disasters, pandemics, significant technology failures, governmental actions, or other extraordinary circumstances. We will make reasonable efforts to process all eligible refunds in a timely manner despite such events. In cases where processing is delayed due to force majeure events, we will communicate with affected customers and extend processing deadlines as appropriate.

Changes and Amendments

We reserve the right to modify this Policy or its terms related to the Website and Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided. We shall make a suitable announcement on the Website. The changes will apply when We have given notice. If You do not wish to accept the revised policy, You should not continue to use the Services. If You continue to use the Services after the date on which the change comes into effect, your use of the Services indicates your agreement to be bound by the new Refund Policy.

An updated version of this Policy will be effective immediately upon the posting of the revised policy unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes.
